smartbargains appears to be somewhat lacking in communications skills.

The writer DiamondHaus brings up a good point.
We pulled 4.3 DSR from eBay's public General Announcements page. This is the location where most people and reporters will get their information about eBay policies. This is also one of the few places where one can see an actual name attached to a Policy, versus an anonymous drone.
Appropriately eBay tags this page as "Marketing", www2.ebay.com/aw/marketing.shtml. Or better known to everyone else as Public Relations (PR).
To find the actual eBay Policies, versus PR felgercarb, you have to dig around. DiamondHaus refers to eBay's actual Policy, as stated in the Seller Non-performance Policy.
To ensure a minimum performance standard from all sellers, eBay requires sellers to maintain at least a 4.3 average for each DSR (Item as described, Communication, Shipping time, and Shipping and handling charges).
Sellers with one or more DSR below 4.3 may be subject to lowered standing in search results.
Sellers with one or more DSRs below 4.1 will be restricted from listing until their DSRs improve.
This average is based on ratings from the past 30 days unless a seller has less than 10 DSRs for that period. In this case, eBay will evaluate DSRs over the past 12 months instead.
As we noted earlier, any restrictions will not be applied until there is a "past 30 days" to make a determination. That would be December 18th.
With this deadline in mind, here is a seller qualification that Diamond PowerSeller smartbargains currently fails at.

"Sellers who have demonstrated buyer dissatisfaction rates greater than 5% within a 90-day window are now subject to temporary 14-day restrictions in the form of selling sanctions or reduced listing volume. Greater than 5% buyer dissatisfaction rate: A seller must have more than 5% negative and neutral feedback, as a seller, over the last 90 days to qualify, and must also receive a minimum of two negatives from unique buyers in the past 90 days.
Greater than 10% buyer dissatisfaction rate: A seller must have more than 10% negative and neutral feedback, as a seller, over the last 90 days to qualify, and must also receive a minimum of three negatives from unique buyers in the past 90 days.
According to Terapeak, as of December 1st, Diamond PowerSeller smartbargains has made their monthly sales quota.

We are of the opinion that eBay will do everything IT can to make Diamond PowerSeller smartbargains meet seller qualifications. Independent of whether smartbargains actually makes the qualifications.
